INJURY AND POST SURGERY REHABILITATION
Our mission is to help horses recover from injuries and surgeries and return to their full potential through specialized rehabilitation and post-surgery care programs.
Our team of experienced professionals has the knowledge and skills to provide the highest level of care for your equine athlete. AGISTMENT AGREEMENT
AGREEMENT BETWEEN
(“the Agistor”)
13 Mile TB Pty Ltd. Trading as Caroda Bloodstock
(“the Owner or Trainer”)
This is person/entity responsible for payment.
Whereby the Agistor agrees to agist the Owner/Trainer’s horse or horses identified below (‘the horse”) at the Agistment property address 340 Thirteen Mile Rd, Garfield Victoria 3814 on the conditions set out below.
1. Agistment Charges:
The Owner/Trainer agrees to pay all agistment charges and other fees incurred by the Agistor as detailed below. These charges will be rendered and payable on a monthly basis. Accounts that remain unpaid for more than 30 days will accrue interest at a rate of 2% per month.
2. Risk and Insurance:
The horse(s) identified below ("the horse") shall be at the sole risk of the Owner/Trainer at all times. It is the responsibility of the Owner/Trainer to obtain insurance coverage for the horse and any progeny against all risks while they are at the Agistment property or during transportation to and from the property. The Agistor shall not be liable for any disease, accident, illness, or injury suffered by the horse while in transit or at the Agistment property.
3. Notification and Veterinary Services:
The Owner/Trainer must immediately notify the Agistor if the horse suffers from or has been in contact with any significant or notifiable sickness, disease, or injury. The Agistor, in consultation with the Agistor's veterinarian, may provide veterinary services for the horse and/or progeny as deemed necessary. All veterinary and related charges incurred during the horse's stay at the Agistment property shall be the responsibility of the Owner/Trainer.
4. Lien:
The Owner/Trainer grants the Agistor a lien over the horse and its progeny as security for payment of agistment fees, charges, and expenses as prescribed in this Agreement. This lien prohibits the Owner/Trainer from removing the horse or its progeny from the property until all obligations under this Agreement have been fulfilled.
5. Sale of Horse and Progeny:
In the event of non-payment for a period of 60 days after the Agistor has sent the account, the Agistor may, at their discretion, sell the horse and/or its progeny by public auction or private sale to recover the outstanding amount owed.
6. Power of Attorney:
The Owner/Trainer hereby irrevocably appoints the Agistor as their attorney-in-fact with the power to sell the horse and/or its progeny and to sign all transfers and other necessary documents to effectuate and complete the sale. The Agistor is authorized to receive the purchase price and apply it towards the costs of sale and any outstanding amounts owed.
